Carter-Ruck is widely considered to be the leading law firm for individuals and entities wishing to take steps, including court action, to challenge the imposition of sanctions and restrictive measures.
Our work has been fundamental in establishing the jurisprudence in this fast-paced area of the law. We pioneered challenges to some of the first targeted sanctions which were imposed in 2001 following the 9/11 attacks in the US, with two successes before the European Court of Justice on behalf of client Sheikh Yassin Abdullah Kadi having set the benchmark for sanctions challenges. Our work for Burmese national Pye Phyo Tay Za is one of the leading authorities regarding the designation of family members; and our successful de-listing work for the late former Egyptian President Hosni Mubarak and his family continues to be cited in EU General Court judgments.
We have successfully represented clients in sanctions proceedings globally, including:
- the United Kingdom, before the Administrative Court in London in domestic judicial reviews of administrative sanctions decisions;
- the United Nations, before the Ombudsperson to the United Nation’s ISIL and Al-Qaida Sanctions Committee;
- the European Union, before the General Court of the European Union and the European Court of Justice; and
- the United States, when advising clients challenging US designations by the Office of Foreign Assets Control (OFAC).
